Ownership: Fully Open to Foreign Investors

Animation, game development, visual effects, graphic design, and related creative services are not listed on the Foreign Investment Negative List. A foreigner can incorporate a 100% foreign-owned domestic stock corporation or a One Person Corporation (OPC) without a Filipino partner. Incentive Opportunities

Two main incentive regimes are available to qualifying animation studios:

PEZA (Philippine Economic Zone Authority): Studios that establish operations inside a PEZA-accredited IT Park or Special Economic Zone can register as IT Enterprise locators. Benefits include income tax holidays (typically four to six years), a preferential 5% tax on gross income earned thereafter (under applicable rules), duty-free importation of equipment, and simplified customs procedures. PEZA registration runs in parallel with SEC incorporation and does not replace it.

BOI (Board of Investments): Export-oriented creative enterprises may register with the BOI under the Investment Priorities Plan, accessing income tax holidays and other non-fiscal incentives. BOI registration suits studios not located inside a PEZA zone.

  1. SEC name reservation and incorporation — via eSPARC or OneSEC. A creative studio typically incorporates as a domestic stock corporation; OPC is available for single-owner setups.
  2. BIR registration — company TIN, registration of books of accounts, and e-invoicing enrolment if applicable.
  3. LGU business permit — obtained from the city or municipality where the studio operates.
  4. PEZA or BOI registration — optional but often pursued immediately to lock in incentive entitlements.
  5. DOLE compliance — Alien Employment Permits for foreign nationals who will work in the Philippines; mandatory prior to employment commencement.
