Night shift differential in the Philippines: the 10% rule, the 10pm to 6am window, how to compute it, who is exempt, and what it costs on a BPO-style roster.

What night shift differential is

Night shift differential (NSD) is a statutory premium, not a shift allowance you can choose to give. Article 86 of the Labor Code requires every covered employee to be paid not less than 10% of their regular hourly wage for each hour worked between 10:00pm and 6:00am. The law treats night work as a health cost, so the premium is owed per hour worked inside that window, whether the shift started at 9:00pm or 2:00am.

The window is exact. Work performed from 6:00pm to 9:59pm earns no statutory differential, and hours from 6:00am onward do not either. Many companies pay an evening premium across a wider window as a company benefit, but anything beyond the statutory 10pm-to-6am, 10% floor is policy, not law, and contract or CBA terms that are more favourable than the statute override it.

How to compute it

The computation follows the worked formulas in the DOLE-BWC Handbook on Workers’ Statutory Monetary Benefits:

  1. Hourly rate: daily rate ÷ 8.
  2. Night-shift hourly rate: hourly rate × 110% (the 10% premium built in).
  3. Night-shift pay: night-shift hourly rate × hours worked between 10:00pm and 6:00am.
  4. Day’s wage: ordinary-hours pay + night-shift pay.

A worked example

An employee earns ₱700 per day and works an 8-hour shift from 10:00pm to 6:00am, all of it inside the night window:

  • Hourly rate: 700 ÷ 8 = ₱87.50
  • Night-shift hourly rate: 87.50 × 110% = ₱96.25
  • Full 8-hour shift inside the window: 96.25 × 8 = ₱770

A partial-overlap shift costs proportionally less. The same employee working 2:00pm to 10:30pm has only 30 minutes inside the window, so the differential is 96.25 × 0.5 = ₱48.13 on top of an ordinary day. This is why roster design, not just headcount, drives the NSD line on your payroll.

Night shift differential on overtime

Overtime and NSD stack. When overtime hours fall inside the night window, the 10% differential is computed on the overtime hourly rate, not the base hourly rate. On the same ₱700 employee, one overtime hour between 10:00pm and 6:00am earns 87.50 × 125% overtime, plus 10% of that ₱109.38 overtime rate as the differential, for ₱120.32 for the hour. Who is exempt

The Labor Code’s Article 82 exclusions carry through to NSD, plus one establishment-size exemption:

  • Government employees, who have their own scheme under Republic Act No. 11701: 20% between 6:00pm and 6:00am, computed on an hourly rate derived by dividing the monthly rate by 22 working days and the result by 8.
  • Managerial employees, meaning staff who meet all three tests: primary duty of managing the establishment or a department, customarily directing the work of two or more employees, and real authority over hiring, firing, or similar decisions.
  • Managerial staff, officers or members of a managerial staff who meet the four-part policy-level test, including devoting no more than 20% of their hours to non-managerial work.
  • Field personnel, non-agricultural employees who work away from the principal place of business with hours the employer cannot determine with reasonable certainty.
  • Kasambahay and persons in the personal service of another.
  • Employees of retail or service establishments that regularly employ five or fewer workers.

Two cautions for foreign founders. First, the managerial exemption fails on titles alone: DOLE and the courts look at actual duties, and night-shift team leads who mostly do the same work as their team are routinely awarded NSD on claim. Second, the five-worker exemption is a knife edge for small service businesses. Cross it in any sustained way and every covered night hour owed the differential becomes claimable.

Foreign founders hire Philippine staff precisely because the time-zone gap turns Manila’s evening into someone else’s business morning. A support team covering US Pacific hours works roughly 11:00pm to 8:00am Manila time, which puts most of the shift inside the statutory window. That means:

  • Budget the differential as a permanent cost, roughly 10% of the wage base for fully night-window roles, not a seasonal line.
  • Check shift start times against the window when you reschedule. Moving a shift from 9:00pm to 10:00pm start can flip hours from premium-free to premium-bearing.
  • Track the window per hour, not per shift. Split shifts and flexible schedules make per-shift averaging wrong.

  2. Apply the differential on overtime and holiday hours too, since the premium layers rather than replaces.
  3. Re-examine “manager” and “lead” titles on night rosters against the actual-duties tests before assuming the exemption holds.

Is night shift differential taxable?

It forms part of taxable compensation income. However, minimum-wage earners are exempt from income tax on their statutory minimum wage plus overtime, holiday pay, and night shift differential, so a minimum-wage earner's differential is effectively tax-free.
